Lumi Terms of Use

These Terms of Use ("Terms") are an agreement between you and Lynx Group LLC ("Lynx Group", "we", "us") and govern your use of the Lumi mobile app and related services ("Lumi"). By downloading or using Lumi, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use Lumi.

1. Eligibility

You must be at least 13 years old to use Lumi. If you are under the age of majority where you live, you may use Lumi only with the permission of a parent or legal guardian who agrees to these Terms.

2. Your account

You may use Lumi as a guest or create an account with your email. Guest data is tied to your device and may be lost if you delete the app or change devices before creating an account. You are responsible for keeping your login details confidential and for activity under your account. You can delete your account at any time in Profile → Delete account.

3. Lumi Plus subscriptions

Some features require a paid auto-renewing subscription ("Lumi Plus"). Plans, prices and included benefits are shown in the app before you buy and may vary by country.

• Payment is charged to your Apple ID (or Google Play account) when you confirm the purchase.
• Your subscription renews automatically at the end of each period at the same price and duration unless you cancel at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours before the end of the current period.
• You can manage or cancel your subscription in your device's account settings (on iPhone: Settings → your name → Subscriptions). Deleting the app or your Lumi account does not cancel a subscription.
• If a free trial is offered, any unused portion is forfeited when you purchase a subscription.
• If you live in the European Union, the European Economic Area or the United Kingdom, you may have a statutory right to withdraw from a purchase within 14 days. Because Lumi Plus and credits are digital content supplied immediately, you agree that the supply starts right after purchase and that you lose the right of withdrawal once it has started, to the extent permitted by law.
• Refunds are handled by Apple or Google according to their policies. We cannot issue refunds for purchases made through the app stores.
• If we change subscription prices, we will give you notice as required by the app store, and you can cancel before the new price applies.

4. Credits

Certain AI features, such as virtual try-on, use in-app credits. Credits are granted as described in the app (for example, a starting balance and a monthly allowance with Lumi Plus). Credits have no cash value, cannot be transferred, sold or exchanged for money, and may expire as described in the app. Monthly credits do not roll over unless the app says otherwise. If a feature fails to produce a result, the credits used for that attempt are returned automatically. Free features may have daily limits.

5. AI features

Lumi uses artificial intelligence to identify clothing, suggest outfits, chat with you as a stylist, analyze colors and body shape and generate try-on images. You understand that:

• AI output is generated automatically and may be inaccurate, incomplete or unexpected. Try-on images are approximate previews, not exact representations of fit, size, color or appearance.
• Style, color and body-shape suggestions are for general entertainment and inspiration only and are not professional, medical or health advice.
• You are responsible for your decisions, including purchases, based on Lumi's suggestions.

6. Your content

You keep ownership of the photos and content you add to Lumi ("Your Content"). You grant Lynx Group a limited, worldwide, non-exclusive, royalty-free license to host, store, process, reproduce and modify Your Content solely to operate, provide and improve Lumi for you, including sending it to our service providers as described in the Privacy Policy. This license ends when you delete Your Content or your account, except for residual backup copies kept for a limited time.

You confirm that you have the rights needed to upload Your Content and that it does not violate these Terms or anyone else's rights.

7. Acceptable use

You agree not to:

• Upload photos of another person without their permission, or photos of minors other than yourself where you are permitted to use the app.
• Upload nudity, sexual content or content that is illegal, hateful, harassing, violent or infringing.
• Use Lumi to create misleading, deceptive or harmful images of real people.
• Try to bypass plan limits or credits, misuse the AI features or interfere with the security or operation of Lumi.
• Copy, reverse engineer, resell or use Lumi to build a competing product, or access it by automated means.

We may remove content or suspend or terminate accounts that violate these Terms.

8. Our property

Lumi, including its software, design, text, graphics and trademarks, is owned by Lynx Group or its licensors and is protected by law. We grant you a personal, non-exclusive, non-transferable, revocable license to use Lumi on devices you own or control, in line with these Terms and the app store's usage rules. If you send us feedback, we may use it without obligation to you.

9. Third-party services and links

Lumi may show links to online stores or rely on third-party services, such as weather data. We are not responsible for third-party websites, products or services, and your use of them is subject to their terms.

10. Changes and termination

We may change, suspend or discontinue features at any time. We may update these Terms; if changes are material we will notify you in the app or by other appropriate means, and continued use after they take effect means you accept them. You may stop using Lumi at any time. We may suspend or end your access if you violate these Terms or if required by law.

11. Disclaimers

Lumi is provided "as is" and "as available". To the fullest extent permitted by law, Lynx Group disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement, and does not warrant that Lumi will be uninterrupted, error-free or that AI output will be accurate.

12. Limitation of liability

To the fullest extent permitted by law, Lynx Group will not be liable for any indirect, incidental, special, consequential or punitive damages, or for loss of data, profits or goodwill, arising from your use of Lumi. Our total liability for any claim relating to Lumi is limited to the greater of the amount you paid us for Lumi in the 12 months before the claim or US $50. These limitations do not apply to liability that cannot be limited by law. Some jurisdictions do not allow these limitations, so they may not apply to you.

13. Indemnity

You agree to indemnify and hold Lynx Group harmless from claims arising out of Your Content or your violation of these Terms or of anyone's rights.

13A. Events outside our control

We are not responsible for delays or failures caused by events beyond our reasonable control, including outages of internet, hosting, AI or payment providers, natural disasters, war, labor disputes or government actions.

14. Governing law and disputes

These Terms are governed by the laws of the State of New Mexico, United States, without regard to conflict-of-law rules. Before filing a claim, you agree to contact us at support@lynxapps.io so we can try to resolve the issue informally. Any dispute that cannot be resolved informally will be brought in the state or federal courts located in Bernalillo County, New Mexico, unless the law of your country of residence requires otherwise. Nothing in these Terms limits rights you have under mandatory consumer protection laws.

14A. General

These Terms, together with the Privacy Policy, are the entire agreement between you and Lynx Group about Lumi. If any provision is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. You may not transfer your rights under these Terms without our consent; we may transfer ours in connection with a merger, acquisition or sale of assets. Nothing in these Terms excludes liability that cannot be excluded by law, such as liability for fraud, gross negligence or willful misconduct.

15. Apple App Store terms

If you downloaded Lumi from the Apple App Store, the following also applies:

• These Terms are between you and Lynx Group only, not Apple. Lynx Group, not Apple, is solely responsible for Lumi and its content.
• Your license to use Lumi is limited to Apple-branded devices you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions.
• Apple has no obligation to provide maintenance or support for Lumi.
• If Lumi fails to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price, if any. To the maximum extent permitted by law, Apple has no other warranty obligation regarding Lumi.
• Apple is not responsible for addressing any claims by you or a third party relating to Lumi, including product liability claims, claims that Lumi fails to meet legal or regulatory requirements, and consumer protection or privacy claims.
• Apple is not responsible for the investigation, defense, settlement or discharge of any third-party claim that Lumi or your use of it infringes that party's intellectual property rights.
• You represent that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and that you are not on any U.S. Government list of prohibited or restricted parties.
• You must comply with applicable third-party terms when using Lumi.
• Apple and its subsidiaries are third-party beneficiaries of these Terms and, once you accept them, Apple has the right to enforce them against you.
